Terms of service.

The rules of the road for using nine.is. Last updated May 10, 2026.

These terms govern your use of nine.is. They're written to be readable — but they're still a binding agreement between you and The Nine. By using the site, you accept them.

Effective date

These terms are effective as of May 10, 2026.

Who we are

The Nine is a US-based digital agency founded in 2007, with offices in Tuscaloosa, Alabama and Portland, Oregon. We do digital marketing, web design and development, content engineering, SEO and AEO, paid media, and custom agentic software development. Throughout this document, we, us, and The Nine mean the agency; you means anyone using the site.

Acceptable use

You agree to use the site in good faith. That means:

  • No scraping, crawling, or bulk extraction of content, except by well-behaved indexing bots that respect robots.txt.
  • No automated submission of forms or other inputs.
  • No attempts to overrun, jailbreak, or otherwise abuse the live agent demos at /agents. The demos are rate-limited and meant for genuine evaluation.
  • No attempts to probe, scan, or test the vulnerability of the site or any underlying systems.
  • No use of the site to violate any law, regulation, or third-party right.

We may suspend access — or block traffic outright — for anyone who ignores these rules.

Intellectual property

The site, its design, copy, code, images, and any other material we publish are owned by The Nine (or licensed to us) and protected by US and international intellectual-property laws. You may view, link to, and quote reasonable portions of the site for normal purposes — research, commentary, evaluation. You may not republish substantial portions, claim authorship, or use our content to train commercial AI models without written permission.

When you submit content through a form — a message, a brief, an attachment — you keep ownership of it. You grant us a limited, non-exclusive license to use that content for the purpose of responding to you and delivering any services you request. Nothing more.

Engagement terms

Nothing on nine.is constitutes a binding offer, contract, or guarantee of services. Actual client engagements are governed by separate written agreements signed by both parties — typically a master services agreement and a statement of work. Pricing, scope, timelines, and deliverables described publicly are illustrative and may change at our discretion until they're captured in a signed agreement.

Limitation of liability

The site is provided as-is and as-available, without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We don't guarantee that the site will be uninterrupted, error-free, or secure, or that any content on it is current or correct.

To the fullest extent permitted by law, The Nine and its officers, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the site. Our total aggregate liability to you for any claim arising out of or related to the site is capped at one hundred US dollars ($100). This cap does not apply to liability that cannot be limited under applicable law.

Indemnification

You agree to indemnify and hold harmless The Nine and its officers, employees, and contractors from any claims, damages, losses, and reasonable legal fees arising out of your misuse of the site or your violation of these terms or applicable law. We agree to do the same for you in connection with our own willful misconduct or gross negligence in operating the site.

Governing law

These terms are governed by the laws of the State of Alabama, without regard to conflict-of-laws principles. Venue for any non-arbitrable dispute lies in the state or federal courts located in Tuscaloosa County, Alabama, and you consent to personal jurisdiction there.

Dispute resolution

We'd rather not litigate. If you have a complaint, email hello@nine.is and we'll make a genuine, good-faith effort to resolve it informally within thirty days.

If informal resolution fails, any remaining dispute will be resolved by binding arbitration administered by a recognized US arbitration body under its commercial rules, in Tuscaloosa, Alabama, or another location the parties agree on. Each party bears its own attorneys' fees unless the arbitrator decides otherwise. You and we both waive any right to a jury trial and to participate in a class action. Either party may still seek injunctive relief in court for misuse of intellectual property.

Changes to these terms

We may update these terms periodically. When we do, the effective date at the top of this page will change. Continued use of the site after a change means you accept the updated terms. If a change materially reduces your rights, we'll make a reasonable effort to flag it on the site.
